Hospital Lien Negotiation Checklist (PI Practice)

Reducing medical liens is where you quietly earn 20% of your client's net recovery. Here's the sequence that gets reductions without burning the provider relationship.

1. Audit the lien FIRST — before you negotiate

Request a full itemized ledger. Pull every CPT code and check against the explanation of benefits. Common finds:

Opening asks are negotiation theater — your first number should be the cap of the floor, not the floor itself.

3. The "common fund" argument

Argue that your fee + case costs created the fund the lienholder is collecting from. Under the common-fund doctrine (recognized in most states), the lienholder's share should be reduced by their pro-rata portion of attorney fees + costs. This is often the quickest 1/3 reduction with no further argument.

4. The "net to client" screening test

Before you accept any lien position, run the math: net to client / gross recovery. If the ratio drops below 25%, keep negotiating or go back to the client with the tradeoffs. A PI client with a $120,000 settlement who nets $18,000 after liens and fees will not refer family — do the hard reductions.

5. Document everything

Every call → one-sentence note with date + rep name + offer. If the lien goes to litigation (ERISA subro disputes, surprise Medicare advantage plans), these notes become exhibits. Rough rule: 10 minutes of note-taking per lien call saves 10 hours of discovery headache later.
